II. Changes

Art. 13

(1) The right of the depositor shall pass to his heirs; it may be assigned, in whole or in part, by any means of law. It may also be subject to a license authorizing other persons to exploit the design.

(2) To be invokable against other persons acting in good faith, all changes concerning ownership or enjoyment of a right shall be entered in the Designs Register.

(3) Requests for registration of changes made in the ownership or enjoyment of a right shall be submitted in writing and shall bear the signature of the depositor. Where circumstances require, the Institute may demand that the depositor's signature be legalized or that other proofs, such as an extract from the trade register, be submitted.

(4) The request for registration of a change concerning the right to deposit an industrial design shall be deemed to have been submitted once the relevant fee invoiced by the Institute has been paid.

(5) Changes of representative shall be entered in the Designs Register on submission of the new powers of attorney issued to the new representative. The request for registration of a change of representative shall be deemed to have been submitted once the relevant fee invoiced by the Institute has been paid.

(6) The initial designation of a representative and the cancellation of designated representatives shall not be subject to a fee.

(7) Where simultaneous registration of several changes is requested in relation to one and the same deposit, only one fee shall be due.
