The microorganism must be publicly available throughout the patent term. Only a recognized depository can provide this assurance. However, certain organisms are so well known in the art and so widely available that their access is probable throughout the life of the patent. This is a fact specific determination best made on a case by case basis by the examiner, who is skilled in this area.
