2.Procedural Requirements for Submission of Information

(1) Documents to be Submitted

In the case of submission of information for a patent application or an application for utility model registration (note):

Please arrange and prepare the documents in pursuance of the instruction in Form No. 20 of Regulations under the Patent Law (see Form of regulatory submission:3.(5) in http://faq.inpit.go.jp/industrial/faq/search/result/10939.html( External link ))

If anyone prefers to submit information on an anonymous basis, please fill "n/a" in the column of "Address or Residence" and "Name or Corporate Name" in the Form of regulatory submission.

(Note)
For the application for utility model registration filed on or after January 1, 1994 (hereinafter referred to as the "New application for utility model registration") and the new utility model registration made under the New application for utility model registration, please arrange and prepare the documents in pursuance of Form No. 15 of Regulations under the Utility Model Law (Article 22 of Regulations under the Utility Model Law).

(2) While Submitting Information:

  • It is preferable to highlight the cited part providing underline, etc., as necessary.
  • If the Information to be submitted is the information included in Patent Gazette stored in Japan Platform for Patent Information (J-PlatPat), please specify the number of Patent Gazette in the column "Publications, etc., to be Submitted" in Form of regulatory submission, in lieu of attaching the Patent Gazette itself.
  • If you intend to submit the Information written in foreign language, it is preferable to submit the translation of the relevant part thereof concurrently (attachment of translation is not mandatory).

(3) How to submit and To Whom the Submission must be addressed

Please send the Submission of Information by mail to Commissioner of Japan Patent Office (Address:3-4-3 Kasumigaseki, Chiyodaku, Tokyo 100-8915)

(4) Fees such as Handling Charges

Submission of Information must be made in writing, fees for submitting the Submission of Information or digitalizing the documents will not be charged.

(5) Feedback to Information Submitter

If Information Submitter wants to be notified whether the submitted Information was used in the first Notification of Reasons for Rejection after the submission of information or not, Examiner will notify about it on the request of Information Submitter by letter in the form below.

If Information Submitter desires to receive the feedback, while arranging and preparing the documents as specified in (1) above, please indicate that Information Submitter wants to receive the feedback in addition to the description of the reason for declaring that, by the submitted Publications, etc., the relevant patent application corresponds to any of the items of Paragraph 1 of Article 13 bis, in the column of "Reason(s) for Submission" of the Form of regulatory submission.
