Submission of Information by Third Parties

Japan Patent Office

Japan Patent Office welcomes a submission of information from a member of the public to improve the effectiveness and expeditiousness of the examination. Supportive information for examination such as information identifying the fact that a certain invention relating to a patent application lacks novelty or inventive step or does not satisfy the requirement of description may be submitted (Regulations under the Patent Law Article 13 bis).

Year by year, the number of information submissions has continued to increase and 76% of the information submissions have been utilized to issue the notices of reasons for rejection (based on the survey on examination practice conducted in January 2007)

Submission of supportive information has been serving to effective and expeditious examination, and we continue to encourage the cooperation from a member of the public as before.
