JPO’s Activities at the 136th International Trademark Association (INTA) Annual Meeting in Hong Kong in 2014

The Japan Patent Office (JPO) will hold a variety of activities at the 136th International Trademark Association (INTA) Annual Meeting in Hong Kong on May 10-14, 2014. The activities include workshop, seminar, and booth.
All of the JPO’s activities will be free and open to anyone who completed registration for the INTA Annual Meeting.* When you attend the Meeting, please visit our booth. We sincerely look forward to seeing many of the attendees.

1.JPO Session(Japan Patent Office (JPO) User’s Meeting)

Revision of the Trademark Act in Japan: Introduction of non-traditional trademarks)
(followed by a question and answer session for 5-10 minutes)

Speaker: Mr. Hirofumi Aoki, Director of Trademark Division, Japan Patent Office (JPO)

Outline

Japan is making headway to expand the scope of trademark protection to include five new types of trademarks, namely, Color Per Se Mark, Sound Mark, Motion Mark, Hologram Mark, and Position Mark. A bill to revise the Trademark Act, so as to enable these non-traditional trademarks to be protected legally, was approved by the Japanese Cabinet on March 11. The bill is now being discussed in the Diet. At this session, we will explain the outline of proposed amendments to the Trademark Act of Japan. In particular, we will explain the addition of protection for the non-traditional trademarks, so that you will better understand the details.

Outline

We will briefly explain the outline of the Japanese trademark system. Also, we will explain in an easy-to-understand manner operational practices of examinations to deal with the issue of non-use trademarks, examination methods using the JPO’s similar group codes, and examination practices such as filings under the Madrid Protocol.

2.TM5 Seminar on Bad-faith Trademark Filings

Topic: Presentation by each of the TM5 offices on their respective legal systems and operational practices to deal with bad faith trademark applications

Outline

The JPO held the First TM5 Seminar on Bad-faith Trademark Filings in Tokyo in October 2013. Fortunately, we received a lot of favorable comments from users in Japan. They indicated that the Seminar was very fruitful and beneficial, because they were able to gain a better understanding of the organizational frameworks and operational practices being developed in each office to deal with bad faith trademark applications.
Again at the INTA Annual Meeting, The IP offices of Japan, the U.S., Europe, China, and Korea will hold the Second TM5 Seminar on Bad-faith Trademark Filings. We believe that the seminar will be a valuable opportunity for users.

3.JPO Exhibition Booth

Date: May 11 (Sun) – 14 (Wed), 2014

Booth Number: 515 and 517

Activities included: Introduction of the Japanese trademark system, demonstration of trademark searches using the Industrial Property Digital Library (IPDL) website operated by the JPO, consultations on trademark issues, and so forth. At the booth, we will prepare brochures explaining the Japanese trademark system, and plan to set up spaces for personal computers and consultations, in order to enable face-to-face communication to be possible with users.
