Foreign Right Holders can Renew Patents through Direct Payment

This new, direct-payment service is in line with an amendment made to the Patent Law of Japan and which came into force on April 1, 2016 enabling non-resident patent-rights holders to remit their annual patent fees directly from abroad.

The direct payment by right holders residing outside of Japan has been implemented from April 1st 2016 according to the Japanese Patent Law amendment.

As long as you wish to maintain your patent right you need to take renewal procedures for the 4th year on (patent annual fees for the first three years have already been paid at the time of registration). For each year, you need to BOTH submit payment form AND pay patent annual fee by the prescribed payment deadline (the details of the deadlines was sent to you together with the registration certificate when your patent right was registered).

As for right holders residing outside of Japan, in order to go through the process of renewal at the JPO, they generally appoint Japanese agents to submit a payment form to the JPO. However they also are able to submit a payment form directly to the JPO without appointing them.

Please be aware that late payment* of patent fees is not applicable.
*If the patent fee for a certain year is not paid within the deadline, a late payment equivalent to double the patent fees can be made if the late payment is paid within six months after the original deadline to pay has expired.

1. Please note below before you start.

  • In case some errors are found on your payment form and/or payment was not made in full, a notification concerning patent annual fee payment or a notification of reasons for refusal to patent annual fee payment is issued by the JPO. Once you received the documents you must go through the following procedure through a representative domiciled in Japan.
  • For anyone who regularly does business with us, we advise them to make this payment process through Japanese agents. They will help you through the payment process.
  • You need to submit a payment form to the JPO only by post. Online submission or fax transmission is not allowed under Japanese Patent Law.
  • Payment by credit card, debit card and/or direct debit is not accepted.

2. Payment form

Please use the following form to pay patent annual fee.

Please fill out this form on the screen and print it out (please do not handwrite because we need to avoid unnecessary errors).

Notes:

  • Please make sure that there is no error on your payment form before you send in the post.

4. Amount of Patent Annual Fees

5. Effective time of payment

In case of payment from overseas, payment shall be deemed to be effective on the date that the payment form is arrived to JPO. Please be aware not to exceed the payment deadline.

6. How to pay us

You have two choices of payment to the JPO.

  • Paying into a Japanese government Account
    You have to pay an annual fee into Japanese government account through a bank by filling out prescribe form at a bank. Fee payable forms must be accompanied with a completed payment form.

Notes:

All bank charges must be covered by the payer. Please instruct clearly to the bank that the payer cover all bank charges.

Please note that no instruction may be considered that the recipient, the JPO, bear the bank charge, in which case the payer will be invited to make up for the balance due, bearing all bank charges again.

The fees are required to be paid in Japanese yen by bank transfer to the following bank account.

Please do not forget to submit the payment form(pdf:104KB) to the JPO after you have paid the fees into the Japanese government account.

  • Patent Revenue Stamps
    You have to affix a patent revenue stamp of the correct value on your payment form and submit it to the JPO through the post.
    Patent revenue stamps are available at post offices in Japan.

Notes:

  • The JPO does not accept the payment by e-mail nor fax.
  • Please note that you have to submit a payment form regardless of your payment methods.
  • You may not pay annual patent fees for more than two patents in one payment sheet.

7. After you pay

  • In case your payment form is accepted
    You will receive a receipt with your patent number and the date you paid.
  • In case some errors are found on your payment form
    Please note that you must work with a representative domiciled in Japan in this situation. From this point you cannot proceed on your own after you have received an invitation to correct or a notification of reason for dismissal. The representative has to be responsible for the following procedure.

In case that the patent fees are paid in error or in excess; or the payment of patent fees is dismissed, the patent fees paid shall be refunded upon the request of the person who paid. The request may be made within one year from the date of the payment through a representative domiciled in Japan.
