Report on the “JICA Training Course for Patent of Computer Software (Malaysia)”

The JICA training course for Computer Software Patents (Malaysia,) the first training course of FY 2012, was held from June 14th through 20th.

The participants were five patent examiners in the field of computer software from MyIPO (the Intellectual Property Corporation of Malaysia).

On the first day, a JICA orientation was held at the JICA-TIC in the morning. This was followed by a presentation from a JPO lecturer at the APIC office, a visit to JPO facilities (INPIT, Appeal Court and Application Counter, etc.), and an APIC orientation in the afternoon.

On the second day, lectures were given by Prof. Minagawa and Mr. Tsuruya. Prof. Minagawa’s lecture was titled “Recent Trends in Computer Software Technology, Remarkable Technologies/Notable Cases (Patents)”. His lecture was very helpful for their examination. Mr. Tsuruya’s was titled "Examination Guidelines: Formulation, Novelty, and Inventive Step in the Field of Computer Software Inventions" (including a comparative study of patentability in Japan, the U.S., the EU and China). Mr. Tsuruya visited MyIPO as a lecturer about two years ago, so he and several participants were able to meet again here in Japan.

On Monday, the third day of the course, participants attended a lecture given by Mr. Hadate titled "Examination Guidelines: Description Requirements and Amendments in the Field of Computer Software Inventions", which provided useful information for daily examination work. This was followed by a practice session in the computer room facilitated by Mr. Ito, where trainees used various patent databases for searches.

The following day, Patent Attorney Mr. Tsunoda provided several case studies on examination practices in the morning, and also explained the procedures for patent litigation. The afternoon included a trip to Cyber Government Square, Hitachi, Ltd., which we were able to walk to in about 15 minutes as it is located quite near the APIC office. Here, participants were introduced to cutting-edge technologies—which are very interesting since they are actually used in daily life—and also listened to a lecture given by Hitachi's IP management.

The week went by fast, with the final (fifth) day featuring appeals-related practice facilitated by Mr. Aita. This was very interesting for trainees because it included many case studies. In the afternoon, an evaluation meeting was held together with representatives from JICA, JPO and APIC, where participants were able to share useful opinions for future training courses. Many trainees said that they would like to learn more regarding utility model rights, and Mr. Ogiya gave a special mini-lecture in response. Regarding utility models, there are no examinations in Japan, but there is a examination for novelty in Malaysia. Participants said they would share the contents of the training course with their colleagues by organizing meetings or short training courses. After this session, the presentation of certificates was held and the training course concluded.

The participants were colleague working in same division at MyIPO, so they displayed good teamwork. After the weekday lectures and during weekends, they enjoyed sightseeing around Tokyo.

Most of lecturers told us that the participants eagerly listened and actively asked questions.

While the course is only a week long, it is a very fruitful week indeed. We hope that participants will share the knowledge they obtained during this course and use it within their daily examinations. We wish them continued success as examiners in MyIPO!
