PPH pilot program between the Japan Patent Office (JPO) and the Spanish Patent and Trademark Office (SPTO)


The Japan Patent Office (JPO) and the Spanish Patent and Trademark Office (SPTO) have commenced the PPH pilot program on 1 October 2010 in accordance with the joint statement of intent at the SPTO/JPO Heads Meeting held in Madrid on 3 September 2010. The JPO and the SPTO have also commenced the PPH pilot program using PCT international work products.

<Note>

Under Spanish Patent System, after 18 months pass from the date of submission of the patent application or from the date of priority, and the request of the Report on the State of the Art is made by applicant, the patent application is published (Article 32(1) and 32(2) Spanish Patent Law) with the report. When a request for PPH is made before the publication, the request for PPH is considered, if applicable, as a request for early publication of the patent application according to Article 32(3) Spanish Patent Law.
