Procedures to file a request in case you have been unable to create a “REQUEST FOR PARTICIPATION IN THE PATENT PROSECUTION HIGHWAY (PPH) PILOT PROGRAM”

When filing request for PPH with JPO, the Explanation of Circumstances Concerning Accelerated Examination must be submitted. When preparing the Explanation of Circumstances Concerning Accelerated Examination, please refer to the following examples and important points.

Common important points on procedures by submitting online and documents on paper

  • If there is any document the submittal of which may be omitted, then establish a title “Documents to be omitted to submit” and make a list of documents omitted for submission as shown in the example below. Do not use 【】 to emphasize the title.
  • Documents which are required to be submitted ( all office actions, scope of claims including claims determined to be patentable, documents cited by examiners of OEE, documents showing correspondence of claims) must all be represented under “Documents to be omitted to submit” or “The list of submitted documents”. Of documents required to be submitted, representation of names of documents itself may never be omitted.

  • All forms must be filled in Japanese.

Important points on procedures by submitting online

  • (1) The “Contents” of the “The list of attached documents” responds to attachment of text or image, but not to ruled line. Enter the claim correspondence table using image or text without ruled line.
  • (2) Document name must be identical in “The list of submitted documents” and “The name of the document” under “The list of attached documents”.
  • (3) ”The name of the document” must be 50 letters or shorter. Space key is not accepted for document name. If a space key needs to be entered, use a fictitious name such as “Attachment 1” and describe the precise name in “Circumstances” column.
  • (4) In order to omit submittal of documents by referring to previously submitted documents, enter the document name in “The name of the document” under “The list of submitted documents”, then establish “Indication of previously submitted documents” and enter indication of the previously submitted application (Patent number, document title, and date of filing if it involved patent right). Do not enter names and contents of the quoted applications in the “The list of attached documents” (It will result in system error).
