Since the beginning of the JP-KR PPH program, many applicants have strongly requested that eligible applications be expand to direct PCT applications (PCT applications without priority claim)
The JPO and the KIPO recently agreed to meet these requests and permit certain applications based on direct PCT filings to qualify for participation in the JP-KR PPH program.
From today (1 July, 2009), a national phase applications under the direct PCT application is eligible to participate in the JP-KR PPH program as depicted in the diagrams below.
1. Filing a PPH request with the JPO
(a) JP national phase application of a direct PCT application
(b) An application which claims priority under the Paris Convention to a direct PCT application
2. Filing a PPH request with the KIPO
(a) KR national phase application of a direct PCT application.
(b) An application which claims priority under the Paris Convention to a direct PCT application
