November 5, 2020

On October 30, 2020, the Global series 2020 Fall Sessions hosted by Federal Circuit Bar Association (FCBA*) was held online. Mr. Kasutani, Commissioner of the Japan Patent Office (JPO) and Mr. Iancu, Director of United States Patent and Trademark Office (USPTO) delivered speeches at the event.

In his speech, Commissioner Kasutani reported JPO’s management and relief measures under COVID-19. Various measures taken by JPO to respond to user needs, such as rapid patent examination to support innovation creation, international cooperation measures that contribute to improving predictability of examinations, and efforts to respond to new technologies, such as the revision of the Design Act and publication of examination cases of AI-related inventions were introduced.

Furthermore, he pointed out last year's legal amendment to review the method of calculating damages and recent precedent on the compensation for intellectual property infringement to promote an understanding of the judicial environment for intellectual property in Japan.
