国際登録第１４３０３７５号に係る国際商標登録出願の拒絶査定に対する審判事件について、次のとおり審決する。

　原査定を取り消す。

　本願商標は、登録すべきものとする。

１　本願商標

　本願商標は、別掲１のとおりの構成よりなり、日本国を指定する国際登録において指定された第９類、第３５類、第３８類及び第４４類に属する国際登録原簿に記録されたとおりの商品及び役務を指定商品及び指定役務として、２０１７年（平成２９年）１２月２８日に米国においてした商標登録出願に基づいてパリ条約第４条による優先権を主張し、２０１８年（平成３０年）３月１日に国際商標登録出願されたものである。

　その後、指定商品及び指定役務については、当審における２０２０年（令和２年）９月２２日付け及び２０２１年（令和３年）５月２５日付けで国際登録原簿に記録された限定の通報があった結果、最終的に、別掲２のとおりの指定商品及び指定役務とされた。

 

２　原査定の拒絶の理由の要点

　原査定は、以下の（１）及び（２）の旨認定、判断し、本願を拒絶したものである。

（１）商標登録を受けることができる商標は、現在使用をしているもの又は近い将来使用をするものと解されるところ、本願において指定する第３５類の役務について、本願商標を使用しているか又は近い将来使用をすることについて疑義があるものである。したがって、本願商標は、商標法第３条第１項柱書の要件を具備しない。

（２）指定商品及び指定役務は、商標とともに権利範囲を定めるものであるから、その内容及び範囲は明確でなければならないところ、本願の指定商品及び指定役務は、その内容及び範囲を明確に指定したものとは認められない商品及び役務を包含しているから，本願は、商標法第６条第１項の要件を具備しない。

 

３　当審の判断

　本願は、その指定商品及び指定役務について上記１のとおり限定の通報があった結果、指定商品及び指定役務の内容及び範囲が明確なものになったと認められる。

　また、出願人が本願商標をその指定役務について使用しているか又は近い将来使用をすることについての疑義もなくなったものと認められる。

　その結果、本願商標は、商標法第３条第１項柱書及び同法第６条第１項の要件を具備するものとなった。

　したがって、原査定の拒絶の理由は、解消した。

　その他、本願について拒絶の理由を発見しない。

　よって、結論のとおり審決する。

　第３５類「Online retail store services for personal digital assistants in the shape of a watch for tracking the key parameters of body, including calories consumed and burned, energy balance, water balance, stress levels, night sleep parameters, steps and distance walked.」

　第３８類「Providing online chat rooms for transmission of messages among computer users concerning fitness, health and wellness; providing online chat rooms for transmission of messages among computer users concerning multifunctional electronic devices for displaying, measuring, monitoring, and uploading health and fitness related information.」

　第４４類「Providing information regarding wellness and health via website.」
