　国際登録第１６０６７０７号に係る国際商標登録出願の拒絶査定に対する審判事件について、次のとおり審決する。

　原査定を取り消す。

　本願商標は、登録すべきものとする。

１　手続の経緯

　本願は、２０２１年（令和３年）４月２８日に国際商標登録出願されたものであって、その手続の経緯は以下のとおりである。

　　２０２２年（令和４年）　５月１１日付け：暫定拒絶通報

　　２０２２年（令和４年）　８月２５日　　：意見書、手続補正書の提出

　　２０２２年（令和４年）　９月　５日　　：上申書の提出

　　２０２２年（令和４年）１１月３０日　　：上申書の提出

　　２０２２年（令和４年）１２月　７日付け：拒絶査定

　　２０２２年（令和４年）１２月２２日　　：上申書の提出

　　２０２３年（令和５年）　３月１７日　　：審判請求書、手続補正書の提出

 

２　本願商標

　本願商標は、別掲１のとおりの構成よりなり、日本国を指定する国際登録において指定された第１類、第５類、第２９類、第３０類、第３１類及び第３２類に属する商品を指定商品として、２０２０年１１月１２日にＥｕｒｏｐｅａｎ　Ｕｎｉｏｎにおいてした商標登録出願に基づいてパリ条約第４条による優先権を主張し、国際商標登録出願されたものである。

　その後、本願の指定商品については、原審及び当審における上記１の手続補正書により、最終的に別掲２のとおりに補正されたものである。

 

３　原査定の拒絶の理由（要旨）

　原査定は、「本願商標は、登録第４６６７２８２号商標（以下「引用商標１」という。）及び登録第６３６３３１４号商標（以下「引用商標２」という。）と同一又は類似の商標であって同一又は類似の商品について使用をするものであるから、商標法第４条第１項第１１号に該当する。」旨認定、判断し、本願を拒絶したものである。

 

４　当審の判断

　本願の指定商品は、別掲２のとおり補正された結果、引用商標１及び引用商標２の指定商品と同一又は類似の商品は全て削除されたものと認められる。

　その結果、本願の指定商品は、引用商標１及び引用商標２の指定商品と類似しないものになった。

　したがって、本願商標が商標法第４条第１項第１１号に該当するとして本願を拒絶した原査定の拒絶の理由は、解消した。

　その他、本願について拒絶の理由を発見しない。

　よって、結論のとおり審決する。
