　国際登録第１５９５６１６号に係る国際商標登録出願の拒絶査定に対する審判事件について、次のとおり審決する。

　原査定を取り消す。

　本願商標は、登録すべきものとする。

１　本願商標及び手続の経緯

　本願商標は「ＬＩＦＴ－Ｏ－ＭＡＴ　Ｘ」の文字を横書きしてなり、第７類に属する日本国を指定する国際登録において指定された商品を指定商品として、２０２０年（令和２年）１１月３日にＧｅｒｍａｎｙにおいてした商標登録出願に基づいてパリ条約第４条による優先権を主張し、２０２１年（令和３年）３月５日に国際商標登録出願されたものである。

　本願は、２０２２年（令和４年）３月１４日付けで暫定拒絶通報の通知がされ、同年９月２８日付けで拒絶査定がされ、これに対して令和４年１１月１日付けで拒絶査定不服審判の請求がなされたものであり、指定商品については、審判請求と同日に提出された手続補正書により、別掲のとおりの商品に補正されたものである。

 

２　原査定の拒絶の理由の要点

　原査定は、「本願の指定商品のうち、第７類「Pneumatic and/or hydropneumatic cylinders and piston cylinders with or without locking mechanisms for apparatus for locomotion by land, air or water.」は、その内容及び範囲を明確に指定したものとは認められないから、本願は、商標法第６条第１項の要件を具備しない。」旨認定、判断し、本願を拒絶したものである。

 

３　当審の判断

　本願の指定商品は上記１のとおりに補正された結果、本願の指定商品は、その内容及び範囲が明確なものになったと認められる。

　その結果、本願は、商標法第６条第１項の要件を具備するものとなった。

　したがって、本願が商標法第６条第１項の要件を具備しないとして本願を拒絶した原査定の拒絶の理由は、解消した。

　その他、本願について拒絶の理由を発見しない。

　よって、結論のとおり審決する。
