１ 手続の経緯 |
本願は、２０２０年（令和２年）３月１７日にＥｕｒｏｐｅａｎ Ｕｎｉｏｎにおいてなされた商標登録出願に基づいてパリ条約第４条による優先権を主張し、同年５月１８日に国際商標登録出願されたものであって、その手続の経緯は、以下のとおりである。 |

２ 本願商標 |
本願商標は、「ＩＳＫＯ」の欧文字を書してなり、第２４類、第２５類、第３５類及び第４０類に属する日本国を指定する国際登録において指定された商品及び役務を指定商品及び指定役務として国際商標登録出願されたものであり、その後、指定商品及び指定役務については、当審における上記１の手続補正書により、最終的に別掲のとおり補正されたものである。 |

３ 原査定の拒絶の理由（要旨） |
原査定は、以下の通り認定、判断し、本願を拒絶したものである。 |
（１）本願の指定商品及び指定役務中に、その内容及び範囲を明確に指定したものとは認められない商品及び役務が含まれるから、本願は、商標法第６条第１項の要件を具備しない。 |
（２）本願の指定役務中、第４０類の役務は、その範囲が広範であるため、出願人が現在又は近い将来において本願商標を使用するか否かについて合理的な疑いがあるから、本願は、商標法第３条第１項柱書の要件を具備しない。 |
（３）本願商標は、登録第２２６９５２６号商標（以下「引用商標１」という。）及び国際登録１０２５２８８号商標（以下「引用商標２」という。）と類似の商標であって、同一又は類似の商品又は役務について使用をするものであるから、商標法第４条第１項第１１号に該当する。 |

４ 当審の判断 |
（１）商標法第６条第１項について |
本願の指定商品及び指定役務は、別掲のとおり補正された結果、その内容及び範囲が明確なものになった。 |
したがって、本願の指定商品及び指定役務は、商標法第６条第１項の要件を具備しないとして本願を拒絶した原査定の拒絶の理由は、解消した。 |
（２）商標法第３条第１項柱書について |
当審において２０２３年（令和５年）２月２７日に提出された手続補正書に添付された資料３「商標の使用意思に関する宣誓書兼事業計画書」により、本願商標の登録出願において指定した第４０類の役務について、本願の使用又は使用の意思があることに疑義がなくなったものと認められる。 |
したがって、本願商標が商標法第３条第１項柱書の要件を具備しないとして本願を拒絶した拒絶の理由は、解消した。 |
（３）商標法第４条第１項第１１号について |
ア 引用商標１ |
本願の指定商品及び指定役務は、別掲のとおり補正された結果、引用商標１の指定商品と類似の商品はすべて削除された。 |
その結果、本願の指定商品及び指定役務は、引用商標１の指定商品と類似しない商品及び役務になった。 |
したがって、本願商標が、引用商標１との関係において、商標法第４条第１項第１１号に該当するとして本願を拒絶した原査定の拒絶の理由は、解消した。 |
イ 引用商標２ |
当審において２０２３年（令和５年）２月２７日に提出された手続補正書に添付された資料４「日本における商標登録についての同意書」は、引用商標２の商標権者によって署名された同意書であるところ、当該同意書によれば、請求人は引用商標２の商標権者の子会社であり、引用商標２の商標権者は、請求人が発行する株式の過半数を保有していること、そして、請求人が本願商標の商標登録を受けることについて了承していることが認められる。 |
したがって、請求人は引用商標２の商標権者の支配下にあり、かつ、請求人が本願商標の商標登録を受けることについて引用商標２の商標権者が了承しているものと認められることから、商標を使用する利便性及び需要者が商品の出所の誤認混同をすることにより不利益を被らないようにする必要性の双方を考慮すれば、本願商標は、引用商標２との関係において、商標法第４条第１項第１１号に該当しないものと判断するのが相当である。 |
（４）まとめ |
以上のとおり、本願を拒絶した原査定の拒絶の理由のうち、商標法第６条第１項、同法第３条第１項柱書及び引用商標１との関係における同法第４条第１項第１１号に係る理由は、いずれも解消した。 |
また、本願商標は、引用商標２との関係において、商標法第４条第１項第１１号に該当しない。 |
その他、本願についての拒絶の理由を発見しない。 |
よって、結論のとおり審決する。 |
