　国際登録第１６４６８６０号に係る国際商標登録出願の拒絶査定に対する審判事件について、次のとおり審決する。

　原査定を取り消す。

　本願商標は、登録すべきものとする。

１　手続の経緯

　本願は、２０２１（令和３年）年４月１６日に国際商標登録出願されたものであって、その手続の経緯は以下のとおりである。

　２０２２年（令和４年）１１月１５日付け：暫定拒絶通報

　２０２３年（令和５年）　５月３０日　　：意見書、手続補正書の提出

　２０２４年（令和６年）　１月１５日付け：拒絶査定

　２０２４年（令和６年）　４月２４日　　：審判請求書、手続補正書の提出

 

２　本願商標

　本願商標は、別掲１のとおりの構成からなり、第１類、第２類、第３類、第２９類、第３０類及び第３２類に属する日本国を指定する国際登録において指定された商品を指定商品として国際登録出願されたものであり、その後、指定商品については、上記１の手続補正により、最終的に、第１類、第２類、第３類、第２９類、第３０類及び第３２類に属する別掲２に記載のとおりの商品に補正されたものである。

 

３　原査定の拒絶の理由の要旨

　原査定は、「本願商標は、登録第６３０２４３３号商標（以下「引用商標」という。）と類似の商標であって、かつ、本願の指定商品と引用商標の指定商品及び指定役務は、同一又は類似のものであるから、商標法第４条第１項第１１号に該当する。」旨認定、判断し、本願を拒絶したものである。

 

４　当審の判断

　本願の指定商品は、上記１のとおり補正された結果、引用商標の指定商品及び指定役務と同一又は類似の商品はすべて削除されたと認められる。

　その結果、本願の指定商品は、引用商標の指定商品及び指定役務と類似しない商品になった。

　したがって、本願商標が商標法第４条第１項第１１号に該当するとして本願を拒絶した原査定の拒絶の理由は解消した。

　その他、本願について拒絶の理由を発見しない。

　よって、結論のとおり審決する。
