The PCT Collaborative Search and Examination (CS&E) is a new framework aimed at producing high-quality products in PCT international applications. For each selected PCT application, a main IP Office will collaborate with peer IP Offices to determine its patentability, and finally provide a single international search report to the applicant. On July 1, 2018, the IP5 Offices - EPO, JPO, KIPO, SIPO, and USPTO - launched a pilot project to test this collaborative approach to international searches under the PCT, based on their agreement to start a pilot project in an IP5 Heads Meeting held in June 2016.

By launching of PCT CS&E, applicants can expect to obtain patent rights overseas smoothly, because it is possible to acquire the search results of multiple Offices in the international phase of a PCT application. Moreover, additional fee for using the CS&E during the pilot period is not required (Search results of the IP5 Offices are available only with the search fee of a regular PCT international application ).

Operation of PCT CS&E Pilot Project

The main features of this Collaborative Search and Examination (CS&E) pilot project are:

  • an applicant-driven approach: the applications processed during the pilot will be selected by applicants
  • a balanced workload distribution: all collaborating International Authorities will contribute to the establishment of each CS&E work product; each office will process approximately 100 international applications in its role as "main ISA" and approximately 400 international applications in its role as "peer ISA" over two years
  • a common set of quality and operational standards - the same search standards as those for normal international applications and a uniform collaborative search schedule- will be applied by all collaborating International Authorities when processing the PCT applications

The IP5 Offices agreed to accept only applications filed in English at an initial stage of the pilot, but they may also accept applications filed in languages other than English at a later point during the pilot.

Request for Participation in PCT CS&E Pilot Project

1. Requirements for participation

Requirements for participation when applicants designate the JPO as the “main ISA”

  • (a) A request form for participation in the pilot project “Request to Participate in the IP5 PCT Collaborative Search & Examination Pilot” indicated in the section 2 must be filled in and filed together with the international application.
  • (b) When designating the JPO as the “main ISA”, the receiving Office must be the JPO, the USPTO, or the WIPO.
  • (c) The request form for participation and the international application must be filed according to the procedure set by the receiving Office. When selecting the JPO as the receiving Office, the internet application software must be used for filing.
  • (d) The request form for participation and the international application documents must be prepared in English.
  • (e) The JPO, as the main ISA, accepts into the pilot project not more than 10 applications filed by a same applicant over two years.
  • (f) The JPO, as the main ISA, accepts into the pilot project not more than 50 applications annually.

2. Procedure of request for participation

Applicants wishing to participate in the pilot project must fill in the English request form which is available below and file it together with the international application written in English. The request form should be submitted in the format of image data. International applications which have already been filed are not acceptable in the pilot project (The request is acceptable only when it is submitted at the same time as the international application is filed online.).

Please note that the maximum number of international applications accepted in the pilot per applicant at a same main ISA is ten over two years.

3. Notes in case of filing a request for participation to the JPO as the “main ISA”

At the same time as the filing of the request form and the PCT international application, applicants are required to notify the JPO of the request for participation via e-mail and email the request form to the JPO at the e-mail address below, setting a password.

The JPO will determine whether a request for participation satisfies the requirements indicated in the “Pilot project between the IP5 Offices on collaborative search and examination under the PCT” and notify applicants of its determination via email. When the request for participation in the pilot is refused, the international application will be subject to international search in the regular PCT international application procedure.

“Peer contributions” prepared by the peer ISAs will be made publicly available on the PatentScope. In addition, applicants will be able to see them on their own applications before the international publication on the ePCT.
