A report was made by the Tegernsee Experts Group about the summary of the study report that was based on the studies regarding the 4 key issues (“grace period”, “treatment of conflicting applications,”, “18-month publication” and “prior user rights”) which were agreed during the 2nd Tegernsee Heads Meeting held in April this year. The Group also reported the results of the comparative analysis result, outlining the degree of harmonization and confirmed the progress of the fact-finding work.
Discussions were held on the direction of future consultation to be pursued by the Tegernsee Group, and it was agreed to 1) engage in a broad consultation of users, including universities and small-to-mid-size companies, on the results of the fact-finding studies on the 4 key issues at this stage, before the 4th Heads Meeting scheduled for next spring, and to 2) immediately begin work to develop a basic, questionnaire template designed for conducting the above mentioned consultation with users so as to facilitate the compilation of information.
The JPO will continuously promote efforts to achieve patent system harmonization by participating in harmonization talks at various international discussions such as the Tegernsee Meetings.
