The Japan Patent Office (JPO) held a workshop on January 24 on countermeasures against bad faith trademark filings for officials of the Intellectual Property Office of Viet Nam (IP Viet Nam). The workshop was part of the "Bad Faith Trademark Project*" led by the JPO within the framework of the Five Trademark Offices (TM5), which includes Japan, the United States, Europe, China, and Korea.
The participants, which included representatives from each TM5 Office, exchanged information on the Bad Faith Trademark Project, and on efforts taken by the TM5 Offices and IP Viet Nam against bad faith trademark filings. Vietnam's IP Law has been revised, and the provisions applicable to bad faith trademark filings have been clearly stated. We introduced the TM5’s experiences in dealing with bad faith trademark filings by providing specific examples, and we received many questions from IP Viet Nam with regard to conducting examinations. IP Viet Nam commented that it was informative and they learned a lot, which showed that the workshop was clearly effective for IP Viet Nam to be able to properly respond to bad faith trademark filings in the future.
The JPO will continue to share information on measures against bad faith trademark filings with IP Offices in countries and regions other than the TM5, and will work to create an environment where trademark rights are properly protected.
