Chapter 10 Entry into Force and Transitional Provisions

 Rule 36 Entry into Force

These Regulations shall enter into force on January 1, 1989, and shall, as of that date, replace the Regulations of the Madrid Agreement Concerning the International Registration of Marks, of June 21, 1974, as amended on September 29, 1975, November 24, 1981, and December 15, 1983.

 Rule 37 Transitional Provisions Concerning the Renewal of Certain Registrations

  • (1) If an international registration effected between December 15, 1966, and December 15, 1973, bears two registration dates, one under the Agreement as revised at Nice on June 15, 1957, or at Stockholm on July 14, 1967, and the other under the Agreement as revised at London on June 2, 1934, and if that registration is renewed within the required time limits having regard to both of the said registration dates, the earlier date shall be considered for the purposes of determining the renewal date.
  • (2) If renewal is effected within the required time limits only in respect of the countries to which the more recent registration date applies, that date shall be considered for the purposes of determining the renewal date.
  • (3) If in an international registration the renewal of which is requested the goods and services are not grouped in the order of the classes of the International Classification of Goods and Services, the International Bureau shall group them itself in consultation with the owner, or with the national Office if it has paid the required fees for renewal, insofar as the time limits referred to in Rule 27(2) permit. Such grouping shall not constitute a change within the meaning of Article 7(2) of the Agreement.
