Examination Policy Planning Office
The PPH is the framework which supports an applicant's acquisition of a patent at an early stage worldwide and enhances the utilization of search and examination results between the world's major IP Offices. Since PPH pilot program between the JPO and the USPTO started in July 2006, the program has always been well-received because, as expected, our users received examination result from the Office of second filing at the very early stage. Based on the results of one and a half years・of pilot program, the USPTO and the JPO are pleased to inform you that the both Offices have decided to start implementation of PPH program on full-time basis since January 4th, 2008.
At this full implementation, based on requests from users, requirements and procedures will be revised as follows.
PCT national stage application without priority claim will be eligible for the PPH program.
When an applicant files a request to the USPTO for the PPH program, it has been required to submit translations of JPO・s all office actions except for the decision to grant . But since January 4th 2008, if the reasons for refusal are notified more than once, the applicant has only to submit the copy for the latest notification and the translation thereof.
When an applicant files a request to the USPTO for the PPH program, the request via EFS-Web (electronic application) will be needed instead of the request via fax.
