When a patent application or a utility model application claiming priority is filed with the JPO, it is possible to omit the submission of paper priority documents to the JPO by requesting it to obtain electronic data on priority documents from an overseas IP office through WIPO Digital Access Service (hereinafter referred to as the “DAS”).
Please note that, on January 1, 2020, the JPO starts Electronic Priority Document Exchange of an Industrial Design application through the DAS.
In order that the Office of Second Filing obtains a priority document(s) from the Office of First Filing through the DAS, you need to take the procedures for acquiring an “access code.”
Since an access code is issued by the Office of First Filing, please inquire of the Office of First Filing for specific procedures.
When the Office of First Filing is the USPTO, for the procedures for acquiring an access code and granting the office authority to exchange the priority document data electronically with other IP Offices, please see “Electronic Exchange of Priority Document Data with the United States Patent and Trademark Office (USPTO)”
You need to request the JPO as the Office of Second Filing to obtain a priority document through the DAS. The specific procedures are described below.
When filing an application, please fill in the column of “【パリ条約による優先権等の主張】 (Claim of Priority under the Paris Convention)” in the Request for Grant of a Patent as the following example shows, and submit it to the JPO. (Please refer to Remark 27 of Format 26 of the Ordinance for Enforcement of the Patent Act, Remark 29 of Format 1 of the Ordinance for Enforcement of the Utility Model Act, and Remark 32 of Format 2 of the Ordinance for Enforcement of the Designs Act.)
Note: Please describe “意匠登録” when your application on which the priority claim is based is an Industrial Design application.

As for the column of “【出願番号】 (Application Number)”, please see an example of how to write an application number for each office, region, or international organization, shown in the list on the page of “How to Describe an Application Number based on which Priority is Claimed under the Paris Convention.”
If you do not know the application number and access code on which the priority claim is based at the time of filing, you can supplement them with the amendment.
The supplemental period is within one year and four months (*) from the earliest filing date of the application on which priority is claimed.
When supplementing, please submit, on-line or in paper form, an “Amendment” to amend the column of the application “【パリ条約による優先権等の主張】” (Claim of Priority under the Paris Convention). In addition, when submitting an “Amendment” in paper form, please create the “[その他]” (Others) column and describe “「特許法第43条第5項の規定による書面の提出」”(Submission of the document in accordance with the Patent Act Article 43(5)). In this case, an electronic fee is not required. When submitting an “Amendment” online, it is not necessary to create the “[その他]” (Others) column.
(*) If notice (notice of non-submission of priority certificate) based on the Patent Act Article 43(6) has been made, within two months from the date of shipment of the notice, it is possible to make amendments to the “【パリ条約による優先権等の主張】” (Claim of Priority under the Paris Convention) column.
Once a utility model right has been registered, it is not possible to supplement the access code with a written amendment. If you wish to add an access code to a utility model right that has been registered within one year and four months from the earliest priority date, you must submit a "document under Article 43(5) of the Patent Act as applied mutatis mutandis under Article 11(1) of the Utility Model Act"(Word: 23KB) (written procedure only).
The replenishment period is three months from the date of application for design registration.
When supplementing, please submit, on-line or in paper form, an “Amendment” to amend the column of the application “【パリ条約による優先権等の主張】” (Claim of Priority under the Paris Convention). In addition, when submitting an “written amendment” in paper form, please create the “[その他]” (Others) column and describe 「意匠法第15条第1項において準用する特許法第43条第5項の規定による書面の提出」(Submission of a document pursuant to Patent Act Article 43(5) as applied mutatis mutandis pursuant to Design Act Article 15(1)). In this case, digitization fees are not charged. When submitting an “written amendment” online, it is not necessary to add the column of “[その他]” (Others).
Note: The procedure is different for international design registration applications. Please refer to “When filing the Hague international application with the JPO as the designated office”.
Note: Please describe “意匠登録” when your application on which the priority claim is based is an Industrial Design application.

When filing the PCT international application with the JPO which is the receiving Office, as the application of the office of second filing, please see “Exemption from Submission of Priority Documents through the DAS for PCT International Applications” with regard to the procedures for requesting the International Bureau to obtain priority documents through the DAS.
In addition, in the case where the procedures for submission of priority documents under the PCT Rule 17.1 (a), (b) and (b- bis) are not performed during the PCT international phase, although it is possible to submit priority documents to the JPO as the designated Office within the prescribed period, in this case, it is NOT possible to be exempt from submission of priority documents through the DAS.
