Revision of Fees under Amended Patent Act of 2021 (effective on or after April 1, 2022)

In accordance with the enactment of the Act on the Partial Revision of the Patent Act and Other Acts and the Cabinet Order Regarding the Organization of Relevant Cabinet Orders Accompanying the Coming into Effect of the Act on the Partial Revision of the Patent Act and Other Acts (hereinafter referred to as “Amending Act” and “Amending Cabinet Order”), the following fees shall be revised; patent-related fees, trademark-related fees, and the international search fee for international application, etc.

Regarding the patent fees and the registration fees (utility models, designs, trademarks) etc., the maximum fees are legally stipulated in the law, and the specific fees are delegated to the Cabinet Order.

The following is a table of the fee revisions after the effective date of the amending act (April 1, 2022) and notes on the application of the new and old fee structures around the effective date.

1. Revised Fees on or after April 1, 2022

(1)Patent Fee （Applications requested for examination on or after April 1, 2004）（Enforcement Order of the Patent Act, Article 8-2）

2. Notes on Application of Old and New Fee Structures

• For patent and other fees paid before the effective date of the Amending Act (April 1, 2022), the fee structure before the revision (hereinafter referred to as the "old fee structure") shall apply.
• For patent and other fees paid on or after the effective date of the Amending Act (April 1, 2022), the fee structure after the revision (hereinafter referred to as the "new fee structure") shall apply.

※In accordance with Article 2 and 3 of the Supplementary Provisions of the Amending Cabinet Order, the old fee structure shall apply even if the payment is made on or after the effective date for the following fees.

• (1) The patent and other fees for obtaining the registration establishing a right where the 30th day (the day following if the office is closed on the prescribed day: Patent Act Article 3(2)) from the date of service etc., (e.g., a certified copy of the examiner's decision) falls before the effective date
• (2) The patent fee remaining payable and the surcharge under Patent Act Article 112,　and the trademark registration fee remaining payable and the surcharge under Trademark Act Article 43 (Limited to the case where the due date for the payment of the patent or trademark registration fee is before the effective date)
• (3) The trademark registration fee and renewal fee for the second half of a 10-year registration period paid in installments under the Trademark Act 41-2 (1) and (7) where the old fee structure applies for the installment payment of the first half of the period under the Trademark Act 41-2 (1) and (7)
• ※In accordance with Article 4 of the Supplementary Provisions of the Amending Cabinet Order, the amount of the international search fee payable shall be the amount in effect as of the date when the international application is filed (see Note). The amount of the preliminary examination fee payable shall be the amount in effect as of the date when payment is made. Based on the date as prescribed, the old fee structure shall apply for those before the effective date of the Amending Cabinet Order, and the new fee structure shall apply for those　on or after the effective date.
