Trilateral Project 24.1-Biotechnology 070

During the examination procedure, the examiner will only call the enablement of the invention into question if there are well-founded reasons of technical character, preferably (but not necessarily) supported by a published document. Such grounds exist if, for example, a specific microorganism isolated by chance and not deposited is being claimed, or where common general knowledge suggests that a claimed invention would not be repeatable. If such serious doubts are raised, it would be the responsibility of the Applicant to demonstrate that the application discloses the invention in an enabling way.
