Trilateral Project 24.1-Biotechnology 103

It is well-known that by use of the classical fusion technique of Kohler and Milstein, monoclonal antibodies against a predetermined antigen can be routinely obtained, i.e. without performing inventive skill. Provided that the antigen is sufficiently disclosed, it is therefore assumed that a person skilled in the art could obtain monoclonal antibodies against it. However, the protein to which the claimed antibody binds has to be clearly defined in the claim. No problems as to the enablement requirement would appear to arise in cases (a) to (c).
