If the DNA disclosed in the prior art encodes a human protein X and the DNA of the claimed invention encodes an allelic mutant of said human protein X, but having several different codons, so that the DNA sequence is distinguishable from that of the prior art, a claim directed to a DNA sequence encoding the allelic mutant of human protein X is regarded as being novel.
