Trilateral Project 24.1-Biotechnology 045

Breadth is not indefiniteness. The scope of the claim is clear from the specification. The claims are read in light of the specification. One skilled in the art would look to the specification and see what is intended for the definition.

However, "transformant" may not be acceptable if the definition in the specification would be considered repugnant to the normally accepted usage of the term. Moreover, applicant's broad interpretation of transformant would appear to include humans.

Such an interpretation would be unacceptable under 35 U.S.C. Sec. 101. However, just because the claimed scope is definite does not mean that the full scope is enabled.
