Comparative Study on Examination Practices among JPO, KIPO and SIPO

Joint Expert Group for Patent Examination (JEGPE) was established in 2009 in order to promote patent cooperation among the JPO, KIPO and SIPO. The trilateral offices conduct comparative studies on patent laws and examination guidelines and comparative case studies on chosen topics every year, so the users can deeply understand the examination standards on their practices and prepare high quality patent applications.

The JPO, KIPO and SIPO have conducted comparative studies on laws and examination guidelines concerning “Inventive step”, “Novelty”, “Requirements for Disclosure and Claims”, and “Amendments”, as well as comparative case studies and published reports on those studies. These reports are available on this website.

Today, we publish our new report titled “Summary of Comparative Studies and Case Studies”, and it is also available on this website (See below).

It is the hope of the trilateral offices that these reports will help you gain a better understanding on different views concerning examination practices at the trilateral offices.

Summary (published in March 2017)

The summary contains 5 sections: I. Inventive Step; II. Novelty; III. Disclosure and Claims; IV. Amendment; and V. Utility Model. Each section includes (1) Key Points, (2) Summary of Comparative Study and (3) Summary of Case Study (except Utility Model which includes Key Points only).

Comparative Study Report

The “Comparative Study Report” consists of a Comparison Outline that lists laws and examination guidelines at each Office under items on a table, and a Comparative Analysis that analyzes and discusses similarities and differences of laws and examination guidelines at each Office item by item among the Offices.

Comparative Case Study Report

In this study, each Office evaluated in common cases, and discussed based on their respective evaluation results. “Comparative Case Study Report” reflects the results of the evaluations.
