On May 19th, JPO held “SEP Symposium 2022” online, where JPO commissioner MORI Kiyoshi gave a presentation.
In this symposium, the latest discussions regarding SEPs in each region were illustrated by the Experts in Japan, the U.S., and Europe.

The panel discussion 1 “Licensing practice and the effect of recent court decisions” included detailed and active discussion on the various issues regarding SEPs, including the interpretation of court decisions and the current practice, which relate to the revision of the “Guide to Licensing Negotiations Involving Standard Essential Patents”, which underscored the difference in the opinion between SEP holders and implementers. The panel was composed of people from domestic and foreign companies and university professors.

Panel discussion 2 “Essentiality check in terms of efficiency for licensing” included detailed and active discussion on the topic of the current situation of essentiality check for SEPs and the ideal system and mechanism to check essentiality. The panel was composed of people from domestic companies, a university professor, and a lawyer.
