PPH pilot program between the Japan Patent Office (JPO) and the National Institute of Industrial property of Brazil (INPI)

The Japan Patent Office (JPO) and the National Institute of Industrial Property of Brazil (INPI) started a Patent Prosecution Highway (PPH) pilot program on April 1, 2017 that accepted applications in specific technical fields. Since December 1, 2019, the two Offices have started a new two-year PPH program to accept applications in all technical fields.

New PPH pilot program has commenced since December 1, 2019

(1) Technical fields of applications eligible for PPH requests

All technical fields will be eligible for PPH requests.

(2) Ceiling on the number of PPH requests

The INPI´s annual ceiling on the number of PPH requests is 400. This number includes the total number of requests based on other PPH programs between the INPI and any other Office. In addition, the annual ceiling on the number of each IPC section is 100. When the number of PPH applications received at the INPI reaches 400, the INPI will announce as such on its website. The annual number of patent applications represents the number of the applications filed from January 1 to December 31 each year.

(3) Number of PPH requests per applicant

The number of PPH requests accepted by the INPI has remained one per applicant per month since December 1, 2019.
